Terms of Service

All digital services, software deliverables, and engineering advisory packages provided by DigitalVisionsdev are governed by explicitly contracted Statements of Work (SOW) executed between the Client and DigitalVisionsdev. These terms constitute the binding commercial agreement governing all service engagements.

Upon complete settlement of all agreed commercial invoices, DigitalVisionsdev irrevocably assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, code repositories, and associated digital assets directly to the Client. No recurring licensing fees or royalty obligations apply post-settlement.

Scope Changes: Any modifications to the agreed project scope must be documented in a formal Change Request (CR) signed by both parties. Scope changes may impact delivery timelines and commercial investment. DigitalVisionsdev reserves the right to adjust timelines proportionally for material scope additions.

Confidentiality: Both parties agree to maintain strict confidentiality regarding proprietary business information, technical architectures, and commercial terms exchanged during the engagement. This obligation survives termination by a period of 24 months.

05

Refund & Reimbursement Policy

DigitalVisionsdev operates on a milestone-based payment structure designed to align commercial investment with verified delivery outcomes. Client satisfaction and transparent delivery are core principles of our commercial framework.

Pre-Delivery Cancellations: If a project is cancelled before any development milestones have been initiated, a full refund of any advance payment will be processed within 14 business days. Cancellation must be communicated in writing to [email protected].

Mid-Project Cancellations: If a project is cancelled after development has commenced but before final delivery, the Client will receive a proportional refund for undelivered milestones. Completed and verified milestones are non-refundable. A detailed milestone reconciliation report will be provided.

Post-Delivery Disputes: DigitalVisionsdev provides a 30-day post-delivery quality assurance window. Any defects or deviations from the agreed Statement of Work identified within this period will be remediated at no additional cost. Disputes outside this window are resolved through the commercial dispute resolution process outlined in the signed SOW.

SLA Retainer Cancellation: Monthly maintenance retainer services may be cancelled at any time with 30 days written notice. No refund applies to the current billing period. All platform configurations and monitoring data will be exported and delivered to the Client upon termination.

Governing Law & Disputes

This agreement and any disputes arising from it shall be governed by and construed in accordance with the laws of the Kingdom of Sweden. Both parties agree to attempt to resolve any commercial dispute through good-faith mediation before initiating formal arbitration proceedings.

Any disputes that cannot be resolved through mediation shall be submitted to the Stockholm Chamber of Commerce Arbitration Institute for binding arbitration under its prevailing rules. The language of arbitration shall be English, and the seat of arbitration shall be Stockholm, Sweden.
